First of all if the incident went down the way the article said it did the guy will be a multi- millionaire and the judge who signed the warrant should have to undergo the same procedure. Not sure what probable cause is in New Mexico but a Texas judge would laugh you out of his courtroom if you requested a warrant for a cavity search and your only PC was the way someone was standing. Even our Justice's of the Peace wouldn't sign that.

I highly suspect there is more to the story than what is being represented by the media and the guys attorney. I have been on many scenes (NOT CAVITY SEARCHES-I WOULD NEVER BE A PART OF THAT) then read the news account the following day and was appalled at how the media reported it. Wasn't even close to accurately presenting the facts of the case.

That being said I foresee some type of legislation being enacted that would require only district judges being able to sign search warrants for body cavities and the standard of probably cause to justify the warrant should be extremely high. Why some police will go through all that trouble for user amounts of dope is mind boggling to me. If the guy had a murder weapon shoved up there then so be it but a couple of joints. Come on.

I get that it seems that there must be some other underlying issue. BUT. Why the need for a damn colonoscopy and three enemas? I don't care if the probable cause was "we saw him jamming a Walmart bag full of heroin in his anus". I was under the impression that someone like that would be held and his poop "observed". I have no clue what the probable cause would have to be which involved 2 digital probes, a colonscopy, 3 enemas, and a couple x-rays, but it seems more than a little unrealistic, and unnecessary. I haven't jumped on the cops because it doesn't seem to be their fault (unless they lied on the warrant paperwork, but that's pushing the envelope too far into imagination). It's not like they took him into an alley and jammed a plunger in his ass, in which case I would be more than happy to badmouth them. But that's not what happened. The judge OK'd this process, and he's the one who should be at fault. Like I said, I'd be curious to hear exactly what it would take to OK this sort of thing over just holding him and sifting his poop. I don't get the "urgency".

As far as enforcing laws, I'm fine with that. It's not the cops I have a problem with when it comes to being allowed to protect myself, it's the legislators and lawyers who propagate the idea that if I do so I'm wrong. While I'm not a fan at all of the changing mindset of most police departments, I've never ever been told by a cop not to defend myself. Quite the contrary. It's the prosecutors, judges, and legislatures that are the problem there. I would like to see a little more thinking and a little less "just following orders/doing my job", though. The police aren't the military, and I'm not sure when it came to be that an awful lot of them think of themselves as such. When I see a county sheriff here with someone pulled over for speeding, and they're standing there dressed like a damn Navy SEAL, there's going to be problems.
